1. Introduction
These Terms of Service govern access to and use of the Counsel Compass SaaS platform published by Aikon group d.o.o., Sremska 2A, 21000 Novi Sad, Serbia (PIB (tax ID) 103671835). By accessing the platform you accept these terms. If you do not agree, do not use the platform.
2. Definitions
“We”, “us” - Aikon group d.o.o. as the publisher of Counsel Compass.
“You”, “your” - the legal entity or natural person using the platform (the therapist).
“Client” - the end user of your services whose data you enter into the platform.
“Platform” - the Counsel Compass SaaS application available at app.thecounselcompass.com.
3. Creating an account
To use the platform, you must be at least 18 years old and provide legitimate professional services in the field of mental health or counselling. You are required to provide accurate information at registration and to keep it up to date if it changes.
You are responsible for the confidentiality of your login credentials and for all activity under your account. If you suspect unauthorised access, notify us immediately at hello@thecounselcompass.com.
4. Acceptable use
You agree to use the platform in accordance with the applicable laws of the Republic of Serbia and that you:
- will not share access to your account with unauthorised persons
- will not use the platform for unlawful purposes
- will not attempt to compromise the security of the platform
- will respect professional confidentiality and the privacy of clients
- will not overload the system (automated scripts, DDoS, etc.)
5. Your data and client data
Your data (therapist profile, account information) is treated in accordance with the Privacy Policy.
Client data that you enter into the platform - you are the data controller of that data and we are the data processor. This relationship is governed by the Data Processing Agreement (DPA), which forms an integral part of these Terms and which you accept at registration. You are responsible for:
- obtaining consent from clients for the processing of their data
- informing clients about how their data is used
- responding to client requests to exercise their rights (access, erasure, etc.)
6. Payment
The subscription is charged in advance for the period you have selected (monthly or annually). Prices are available on the website and may change with 30 days’ prior notice.
If you do not pay the subscription on time, access to the platform may be suspended. 30 days after suspension, the account is permanently deleted (with the option to export your data during that period).
7. Intellectual property
The Counsel Compass platform (code, design, logo, brand) is the property of Aikon group d.o.o.. You retain ownership of all data you enter into the platform (yours and your clients’).
You may not copy, modify, distribute or reverse-engineer the platform or any part of it.
8. Limitation of liability
The platform is provided “as is”. We strive to ensure high quality and availability, but we do not guarantee that the platform will always be available or free of errors.
Our liability is limited to the amount you have paid for the platform in the last 12 months. We are not liable for consequential, indirect or punitive damages to the extent permitted by law.
Professional liability: you are responsible for your professional work with clients. Counsel Compass is a tool, not a substitute for professional judgement, ethics or compliance with professional standards.
9. Termination
You may cancel your subscription at any time from Settings → Account. After cancellation you have 30 days to export your data before it is permanently deleted.
We may terminate the agreement if you breach these terms, with prior notice (except in the case of serious breaches such as abuse of the system or violation of the law).
10. Changes to the terms
We may change these Terms. If the changes are material (affecting your rights or introducing binding new provisions), we will email you 30 days in advance and display a banner in the application.
11. Governing law
These Terms are interpreted in accordance with the law of the Republic of Serbia. We will seek to resolve all disputes amicably. If that is not possible, the competent court in Novi Sad has jurisdiction.
